Groundwater and soil quality in land leases

Sustainable principle:

avoid groundwater and soil pollution

Potential benefits:

Clean soil and groundwater, Public health

Description:

Clauses in concession agreements stating that the land must be returned in the same state as at start of lease can avoid careless practices during the lease period. Such clauses can mandate that all pollution must be managed and controlled and a damage restitution must be paid. This could for instance include that soil and groundwater quality must be monitored, stipulation of principles of a clean soil declaration, identification of sources and source control programmes to stop and/or mitigate pollution. Enforcement of such regulations is needed and requires capacity from the port authority or other relevant agency.
